UPDATE: High speed pursuit leaves one dead and another charged with murder

LAWRENCE COUNTY, Ky. (WYMT) - UPDATE 10/07/13

A Johnson County man is in jail, facing several charges including murder after a police pursuit came to a deadly end...killing an innocent man.

Kentucky State Police are working to gather more information about events that happened in Paintsville on Friday, leading to the pursuit that ended with a crash on KY 644 in Louisa.

Officials say Paintsville Police responded to domestic dispute Friday evening between 34-year-old, Joshua Fitzpatrick, and a family member.

KSP Sgt. Jim Goble says, "At that point he was reported to be intoxicated and also stole her vehicle and left the scene."

State police then received a reckless driving report of a vehicle traveling north on US 23 towards Louisa...the description matched the stolen vehicle.

"Our trooper located that vehicle and attempted to stop the vehicle. The subject, Mr. Fitzpatrick, refused to stop the vehicle," says Sgt. Goble.

The pursuit continued onto KY 644 where it came to a deadly end. Goble says, "That is what lead us to this situation we are in, where a collision was involved with a subject on a motorcycle, and he had no clue what was coming. He was completely unaware of the situation and it is sad."

Justin and Travis Russell watched from their porch as Fitzpatrick lost control of his vehicle crashing into motorcyclist Johnny K. Maynard, Jr.

Just Russell says he keeps replaying the scene in his head, "To relive that moment over and over is horrible."

The two men rushed down to help Maynard, using one of their belts as tourniquet...trying to save the innocent man's life, whose wife was on a bike in front of him.

Russell says, "I had his head in my arm and he said please don't let me die man."

Maynard died at the hospital. Officials arrested Fitzpatrick and charged him with murder.

State police say more charges are pending as they continue to investigate with the help of the Paintsville Police Department.

Fitzpatrick is being held at the Big Sandy Detention Center, he declined our request for an interview.

Police say a domestic dispute resulted in a stolen vehicle, a high speed chase and one man being charged with murder.

State Police say they received the call around 6:30pm about a reckless driver on US 23 in Lawrence County driving a stolen vehicle.

When police caught up with the driver he tried to get away, speeding along Route 644. The driver lost control of his vehicle, striking a motorcycle going the opposite direction.

Police say 40-year-old Johnny K. Maynard suffered life-threatening injuries and was transported to Three Rivers Medical Center where he was later pronounced dead.

Police arrested 34-year-old Joshua Fitzpatrick. He is charged with Operating a Motor Vehicle While Under the Influence, Fleeing and Evading Police and Murder.

Fitzpatrick is being held in the Big Sandy Regional Detention Center.
