New details about man shot and killed by State Police

FLEMING COUNTY, Ky. (WKYT) - We're learning new information about a deadly shooting involving Kentucky State Police.

The shooting happened Thursday on Beechburg Road in Fleming County.

State police were back out collecting evidence on Friday. The family of the man shot, James Hay, tells us they're still trying to piece together just what happened, and what went wrong

"I don't really don't understand all of it, or at least his part of it. We're processing that right now. That's really all we can do, take it one minute, one step at a time," said Kay Bivens who lived with Hay for 21 years. She says an argument they had at their home led to him calling police but what happened after, she's still trying come to terms with.

"He was wanting to leave and I suggested that he not, we have a kid to think of. After that I really don't know what was going through his mind," said Bivens.

Kentucky State Police tell us they came out yesterday afternoon after the Fleming County Sheriff's department called them in to assist.

They say when they arrived Hay confronted them with a gun and they pleaded with him for about an hour to put it down.

Bivens says that gun was unloaded.

"I don't even want to draw conclusions because I don't know. Whatever he was thinking or feeling, I couldn't tell ya because he wouldn't talk to me after that."

Police say Hay threatened them with that gun and that's when a trooper shot and killed him. On Friday Hay's family was back out at the home, trying to run through the events of the last 24 hours.

"I'm trying to put myself in that position and I can't even fathom what he was thinking, let alone what he was feeling," said Bivens.

James Hay's body has been sent to Frankfort for an autopsy.
State Police tell us the shooting is under administrative review. They say that is standard policy whenever a trooper is involved in a deadly shooting.
