Arraignment in Lexington murder case delayed

LEXINGTON, Ky. (WKYT) - A delay, on Thursday, for a suspect accused of beating an elderly man to death.

Police charged Cory Etherington on July 23rd with the murder of John Tully. It happened at an apartment complex on Appian Way.

Etherington showed up for his Circuit Court arraignment, but it was postponed until November 7.

Lexington Police Detective Timothy Upchurch testified in court, elaborating on Etherington and Tully's previous relationship.

"I started looking into associates of Mr. Tully, the victim. I learned that Mr. Etherington was a prior roommate of the elderly gentleman," Detective Upchurch said.

Detective Upchurch testified that he learned John Tully had asked Cory Etherington to move out about a year ago.

So the investigator followed up with the lead and ended up finding Etherington at his grandmother's house.

Police brought the suspect to police headquarters to question him.
But before that began, the detective noticed a substance that looked like blood on Etherington's shoes and pants.

Detective Upchurch said, "I confiscated those shoes and sent those to the Kentucky State police lab to be analyzed. The Kentucky State police lab analyzed the blood on Mr. Etherington's shoes, and confirmed the DNA from the shoes was that of Mr. Tully, the victim."

Tully, 87, was found severely beaten outside of his Old Farm apartment back on July 11th. He was rushed to the hospital, where he died two days later from his injuries, which police said were consistent with being struck by a hammer.

Etherington faces a murder charge and probation violations.

The judge found enough probable cause to send the case to a grand jury.

The judge also ordered that Etherington undergo a mental health evaluation.
