LEXINGTON, Ky. (WKYT) - In an unusual twist, convicted rapist and captured fugitive John Buckley refused to attend his arraignment this afternoon prompting the judge to reschedule it.

WKYT's Elizabeth Dorsett says when Judge Julie Goodman called Buckley's name for his video arraignment there was a long pause before a guard explained Buckley refused to leave his cell. After discussing the situation, the judge marked Buckley non-compliant and rescheduled the arraignment for Thursday.

Buckley who walked away from the Fayette County Courthouse shortly before being convicted of rape in July 2012 was the subject of a 10-month manhunt that ended in Wyoming.

After a brief legal fight that led to him being extradited to Kentucky, two Fayette County sheriff's deputies and a state trooper flew to Wyoming Tuesday morning and brought Buckley back to Kentucky on board a Kentucky State Police plane.

Fayette County Sheriff Kathy Witt says normally her office will fly fugitives on commercial airlines if they're more than 500 miles away. But because of Buckley's history they chose to fly him privately, using a plane operated by Kentucky State Police.

"Due to the high risk nature of this convict and the way he has acted in the past, without hesitation we contacted our aircraft pilots," said Kentucky State Police Major Mike Crawford.

Police say they had no issues with Buckley during the trip to Kentucky.

Buckley faces new charges of first degree bail jumping, tampering with a physical monitoring device, and two counts of contempt of court.

"I think it gives the victim and the other victims that are awaiting trial some sense of closure," Sheriff Witt said.
