Police say they don't plan to charge a Laurel County homeowner with anything after he shot another man to death outside his home.
The mother of the man killed say she's not necessarily blaming the homeowner, but someone else for losing her son.
Police say a man named Mark Martin was going door to door along Highway 552 in Keavy, looking for his girlfriend after an argument.
Police say the girlfriend wasn't here at a trailer, but Martin wouldn't take no for an answer.
That's when 26 year old Josh Broughton became involved.
"When the homeowner made him leave the property he went back to where his buddy was at, the victim in this case," Brad Mitchell of the Laurel Co. Sheriff's Department said.
"Then he went back and woke up my son, pulled him in the driveway, and had my son go knock on the door," Beverly McAdams, mother of the alleged shooting victim.
Josh Broughton had been drinking with Mark Martin and Martin's girlfriend earlier.
Police say Broughton tried to open the John Harrod's front door and threatened Harrod.
Police say Josh Broughton did not have a gun when he went to this trailer and threatened the homeowner here, but they do say at some point he reached down for something and that's when he was shot.
"The homeowner thought he was reaching for a weapon,
"When he reached for something he was probably reaching for a lighter to light his cigarette, he didn't have any weapons," McAdams said.
A kentucky law passed last year allows homeowners to use deadly force if they feel threatened.
Police say in this case it looks like the homeowner had a right to shoot Josh Broughton.
"If somebody's trying to break in they don't have to wait until somebody gets in on them before they can defend themselves," Mitchell said.
"I know he's the one that pulled the trigger, but it don't feel he's the one that killed my son. I feel Mark Martin did because he knew his life was in danger when he took him back to the house," McAdams said.
Josh Broughton's mother feels her son got involved with the wrong crowd and now his five year old son has lost his father for good.
Josh Broughton's friend, Mark Martin, was arrested and charged for disorderly conduct, alcohol intoxication, and resisting arrest.
A Laurel County Grand Jury will decide if there will be any other charges in the shooting.
