Former Band Director's Trial Begins

A former band director at several eastern Kentucky schools is accused of having sex with one of his students.

Thomas Pike faces sodomy charges in two counties.

On Tuesday his case in Whitley County went to trial.

Prosecutor Allen Trimble argues that Thomas Pike, while band director in Letcher County, had oral sex with one of his students on several occasions in 2002 and 2003 in Williamsburg, while Pike and the 14 year old boy were both attending band recitals and competitions there.

The boy's mother took the stand and a large part of her testimony centered around phone conversations between Thomas Pike and her son she taped in late 2005.

The prosecution says they show just how close the two were.

The boy's mother testified she was actually dating Thomas Pike when she grew suspicious.

She said Pike was always wanting her son to be with them on dates.

On one phone call, Pike asks the boy to take his clothes off because he's coming over.

But Thomas Pike's defense attorney argues the tapes were recorded years after the alleged incidents took place and requested they be thrown out of evidence the jury can consider.

The judge will announce his decision on that when the trial resumes Wednesday.

Thomas Pike could face up to thirty years in prison if convicted.

In Letcher County, Pike faces dozens of charges of sodomy.

He has pleaded not guilty to all charges in both counties.
