Paintsville Business Owner Indicted for Charges of Polluting Waters

ASHLAND, Ky. - David L. Bowling, owner of Dave's Concrete Products and Septic Service, Inc., was indicted today by a federal grand jury for polluting the waters of the United States.

The indictment alleges that from December of 2005 until December of 2006, Bowling, 59, of Paintsville, Ky., individually, and on behalf of his company, knowingly discharged septic waste into waters in Johnson County.

If convicted, he faces up to three years in prison and could be fined a minimum of $5,000, and up to $50,000, per day of violation or $250,000, whichever is greater. Any sentence following conviction will be imposed by the Court after consideration of the U.S. Sentencing Guidelines and applicable federal statutes.

The investigation was conducted by the United States Environmental Protection Agency and the Kentucky Environmental Public Protection Cabinet.

Appearances before United States District Court have not yet been set by the court in Ashland, Ky. The United States was represented in the case by Assistant United States Attorney Robert M. Duncan, Jr.

The indictment of a person by a grand jury is an accusation only, that person is presumed innocent unless proven guilty.
