FRANKFORT, Ky. (WYMT) - The Kentucky Health Benefits Exchange, approved by Governor Steve Beshear last year by executive order, is being challenged by tea party activists.

Attorneys for the state are asking for dismissal of the lawsuit, saying the activists lacked legal standing to file it.

In the lawsuit, activist David Adams claims Beshear created the exchange without necessary legislative approval.

Beshear ordered the creation of the Kentucky Health Benefits Exchange to help more than six hundred thousand uninsured Kentuckians get coverage under the federal Affordable Care Act.
