Bell County Judge Executive trying to prevent sale of fire stations

BELL COUNTY, Ky. (WYMT) - The Bell County Judge-Executive and Board of Elections are trying to prevent the sale of some fire stations.

The Bell County Volunteer Fire Department is planning to sell three buildings due to alleged financial woes.

Fire stations in Colmar, Calloway, and Brownies Creek are up for sale. The three stations were closed several months ago.

The Bell County Volunteer Fire Department says there is not enough money to run them since the Fiscal Court stopped giving them the taxpayer fire protection dollars when some of the fire stations closed.

"They seem to be bent on destroying or selling what the taxpayer built over the course of thirty years," said Judge-Executive Albey Brock.

However, the Fire Department says the buildings are not taxpayer owned, and claims the buildings are owned by the fire department. Firefighters claim they have a right to sell the them.

Now Judge-Executive and Board of Elections have filed what is called a "Lis Pendens" on the property title deeds. Albey Brock says the "Lis Pendens" documents basically mean "buyer beware."

"We felt that not only to try to protect the taxpayer interest in properties but to let any potential buyer know that there is some issues surrounding these properties and might want to be cautious as they move forward with their money," Brock said.

"Judge Brock is trying to put a cloud on the title of the firehouses owned by the Bell County Fire Department. The Volunteer Fire Department will need to incur more legal fees to clear these illegal filings. This is a reckless act by a man determined to destroy the fire department," said Mark Hayden, attorney for the Bell County Volunteer Fire Department.

The fire department is scheduled to open bids on the three buildings on October 9th.

The three fire stations are also used as election polling places which is why the Bell County Board of Elections also filed legal paperwork. Officials say the Board of Elections will have to find new polling places if the buildings are sold.
