Controversy still surrounding Martin's mayor race

PRESTONSBURG, Ky (WYMT) - The former and current Martin Mayor were in court Tuesday for a recount of votes from the November 2012 election.

Sam Howell defeated incumbent Thomasine Robinson by just a few votes, but the former mayor is still questioning the numbers.

"They have filed a lawsuit asking for a recount, and they are also contesting the election on various other grounds," said Floyd County Attorney Keith Bartley.

On Tuesday, attorneys representing the county board of elections and both the former and current mayor shuffled through absentee ballots looking for anything unusual.

"We will be looking at whether the recount looks valid, and if it doesn't we will take it from there," said attorney Doug McSwain who is representing Thomasine Robinson.

The recount has not been finished yet. Attorneys still need to see some different documentation including the actual ballots from the City of Martin race, but it was said in court that those are in the hands of the FBI.

McSwain says they are also questioning the election in general. He says he believes that some people that voted in the election for the city that should not have.

Another hearing date is scheduled for next Tuesday.

There was also an investigator from the Attorney General's Office at the hearing, but he could not comment if there was a criminal investigation into the election.
