BYPRO, Ky. (WYMT) - UPDATE 4/15/14
Investigators presented their evidence against a man facing murder charges in Floyd County.
Last week police found, Rodney Mullins, shot to death outside a home in the Bypro community. Police arrested Tyler Shehan. At Tuesday's hearing, investigators explained how the two men knew each other.
Detectives worked for hours at the scene, interviewing witnesses including a neighbor who described a prior conversation with Shehan.
Detective Jason Dials says, "He stated Mr. Shehan said that if Mr. Mullins came to the residence causing problems he wouldn't fight him, he would just shoot him."
Just a few days after that conversation the neighbor then watched the events unfold.
Det. Dials, recalls the neighbor's statement, "He was telling Mr. Shehan to come outside if he wanted to whip him and do so, something to that effect, he stated just a few seconds later as he took a step off the porch...that is when the shooting occurred."
Detectives say a woman was also at the apartment. Dials says, "Brandi Mullins, is the girlfriend of Mr. Shehan. She is also the wife of Mr. Mullins...it is my understanding their divorce is not final."
Brandi Mullins was interviewed, Det. Dials says, "She stated he was yelling back and forth with Tyler. He made some kind of comment that he would just finish it today, that is when he rushed into the apartment and the shooting happened."
Detectives say another witness to the shooting is Brandi Mullins' teenage son.
"Stated that he was on the porch when the shooting occurred. He stated that Mr. Mullins was just inside the doorway, just a step or two inside the doorway. When the shots went off Mr. Mullins fell, struck the stove in the kitchen area, and fell back into the doorway...which is where troopers found him," says Det. Dials.
Officials explain that Shehan talked with dispatchers before troopers arrived on the scene.
Det. Dials says, "On the phone call he actually tells her that he still has the weapon in his hand, and that he was going to lay it down prior to law enforcement getting there...after being told by the dispatcher to do so before coming outside."
Defense attorneys argue Shehan should not be charged with murder, "He stepped foot inside the home in order to fight with him, that is fairly textbook self-defense. At the point someone steps in your home looking to do bodily harm to you, you have the right to use lethal force."
The judge did amend Shehan's bond to 50,000 dollars on conditions of GPS home incarceration in Jefferson County, which is where Shehan is from and his parents currently live.
Based on what he heard the judge kept the murder charge and did decide there is enough evidence to send this case to the grand jury.
In addition to the murder charge, Shehan is also facing four counts of wanton endangerment. Officials say those charges are for other people in the vicinity of the shooting...including the teenager and a six-month-old baby.

Kentucky State Police continue to investigate a deadly shooting in the Bypro community of Floyd County.
Troopers responded to a shooting complaint around 3 o'clock Tuesday afternoon.
Once on the scene officials say they found 43-year-old, Rodney Mullins (Melvin, Kentucky), dead from gunshot wounds.
Troopers also found another man at the scene and took him into custody.
Tyler Shehan, 23-years-old of Louisville, was arrested and charged with one count of Murder and four counts of Wanton Endangerment 1st Degree.
Shehan is in the Floyd County Detention Center.
The incident remains under investigation by KSP Post 9.
UPDATE 11:00 PM:
One man is dead following a shooting this afternoon. Officials with Kentucky State Police tell us it happened in the Bypro community in Floyd County around 3:00 pm. Crews left the scene of the shooting around 9:00 pm.
State Police worked for about five hours to collect evidence at an apartment building in the small Floyd County community after receiving a call Tuesday afternoon about a possible shooting.
Trooper Shaun Little says “Upon arrival they located a deceased male and also located another male they took into custody."
A short time later the Floyd County Coroner, Greg Nelson, arrived on the scene.
He says the man in his 40s, died from multiple gunshot wounds. Nelson says the body will be sent to Frankfort for an autopsy, which will be conducted on Wednesday.
Officials are not yet releasing the name of the victim, or the man they took into custody.
The incident remains under investigation by Kentucky State Police Post 9.

Kentucky State Troopers tell us one man is dead and another was arrested following a shooting in the Bypro Community of Floyd County.

We just got off the phone with the Floyd County Coroner who says he is on the way to a shooting near the Wheelwright community.
He says it happened just before 3:30 p.m. Tuesday.
