The case against a man from Logan County accused of murdering his wife will finally see a courtroom.
Jerry Godby has been indicted on a first-degree murder charge.
He was arrested in May 2011 after he admitted to police he shot and killed his wife Delores at their home in Chapmanville.
He said his wife had been hitting him with a beer bottle.
Last summer at a preliminary hearing, a Magistrate Court Judge found no probable cause to charge Godby with first-degree murder.
Prosecutors went ahead and presented the case to the grand jury -- and they disagreed.
Godby will be arraigned on June 4.
