After deliberating for more than four hours, a jury did not reach a verdict in a Letcher County murder trial.
25-year-old Jonathan Anderson took the stand today in his own defense.
He is charged with murder after hitting Gwendolyn Whitaker's vehicle and killing her on the Whitesburg by-pass at Stone Avenue last November.
Anderson and his defense admit he is guilty, but attorneys argue the prosecutor over-charged him for the crime.
They say Anderson is guilty of reckless homicide, not wanton murder.
While on the stand, Anderson admitted to drinking eight beers and having a shot of whiskey before getting behind the wheel that day.
"I didn't feel like I was terribly intoxicated at the time. I did not feel like I was," said Anderson.
"Most drunks don't. But did you know you were under the influence of alcohol?" said prosecutor.
"Yeah," said Anderson.
Both families say they are sorry about what happened because someone's life was taken that day.
The jury will continue deliberating tomorrow at 9 a.m.
