Lawsuit alleges excessive force by officers

LONDON, Ky (WYMT) - A police department and a hospital are named in a federal lawsuit that claims excessive force was used on a patient.

The lawsuit was filed in November by Jami Jackson, formerly Jami Morgan, who says she was tased by officers of the London Police Department while being treated in the emergency room at Saint Joseph's London.

Jami Jackson's attorney Jason Kincer says his clients rights were violated on November 19, 2011 at Saint Joseph's Hospital in London.

"This case involves a violation of the 4th Amendment of the right to be free from unreasonable or excessive use of authorities," said Kincer.

The complaint states Jami Jackson was extremely intoxicated and was taken to Saint Joseph's Hospital for medical treatment.

It says she was placed in a private room with her hands and feet bound in leather restraints. The police were also called.

"Approximately eight minutes after being restrained she was tased multiple times by an officer from the London City Police Department," said Kincer.

The complaint says Jackson suffered severe fear, pain, anguish and consternation as a result of getting tased multiple times in the neck.

Kincer says he believes this was an unnecessary, excessive use of force.

"I have a hard time believing the use of a taser when someone is in a hospital room under four point restraint under doctor's orders, that they would be justified in using a taser," said Kincer.

Jackson is seeking punitive damages and attorney fees.

The London Police Chief did not want to comment because the department had not been served yet.

An official with KentuckyOne Health, a partner of Saint Joseph London, released this statement about the lawsuit.

"Patient safety is a top priority for our organization. Our goal is to care for patients in ways that keep them safe while being treated. Our staff followed procedure during the patient's emergency department visit."
