Logan County, West Virginia woman pleads guilty to federal arson charge

A Logan County woman pleaded guilty Tuesday to conspiracy to commit arson at a residential building in Boone County, W.Va., according to a news release from U.S. Attorney Booth Goodwin's office.

Kimberly Dawn Kinder, 46, of Chapmanville, W.Va., admitted that around September 2009, she conspired with a known individual to burn down a residential rental unit located in Van, W.Va.

Kinder further admitted that for her role in starting the fire at the Van Duplex, she would in exchange receive about $4,000 in insurance proceeds from the known individual.

Kinder admitted that on Oct. 14, 2009, she went to the Van Duplex late at night, entered one of the rental units and poured gasoline on a pile of clothes in the living room. Kinder further admitted that she lit the pile of clothes on fire and left the complex.

The Van Volunteer Fire Department later responded to the incident and extinguished the fire, but the property sustained extensive damage.

On Oct. 15, 2009, a known individual filed an insurance claim with Nationwide Insurance Company (“Nationwide”) as a result of the fire damage to the Van Duplex. Nationwide in turn paid the known individual $80,716.51.

The defendant admitted that the known individual then paid her about $2,000 in small increments on several occasions as payment for her role in the conspiracy.

On June 4, 2010, after initially denying her involvement, Kinder admitted starting the fire at the Van Duplex as part of her agreement with the known individual to commit insurance fraud.

Kinder faces up to five years in prison and a $250,000 fine when she is sentenced on Sept. 26, 2012, by U.S. District Judge Thomas E. Johnston.
