SALYERSVILLE, Ky (WYMT) - Emotions ran high Friday in a Magoffin County courtroom as a judge rejected a plea deal offered in a case involving the death of a four-year-old.
Some family members of Cameron Mullins, who died almost two years ago, were upset that his father, James Garcia, might only be sentenced to 16 months in prison.
He was first charged with manslaughter in the case.
The coroner said Cameron died of blunt force trauma.
"It's been really hard. There is not a day goes by that I don't think of my grandson. And I just miss him," said Cameron's Grandmother Dorothy Mullins.
His father James Garcia and his girlfriend Cindy Collins were both charged with manslaughter.
Last year, Collins pleaded guilty to an amended charge of falsely reporting an incident.
In February, Garcia also accepted a plea deal to the amended charge of reckless homicide with a 16 month sentence.
The judge said in court Friday that court could not accept that plea deal.
"I've had bad luck in my head thinking he was going to get out, and I think he needs to spend more time whether five years or 10 years. It will never bring back my son, but he needs to spend more time for what he has done," said Jessica Mullins, Cameron's mother.
The defense filed a motion asking the judge to recuse herself. A hearing for that has been set for next week.
A new trial date was not set.
Garcia's family did not want to comment.
