The Floyd County man accused of driving drunk and then hitting a car, seriously injuring a five year old is now out of the hospital and in jail.
Police say Marion Kilburn was driving on the wrong side of U.S. 23 two weeks ago when he crashed head on into car with a man and his daughter inside.
Kilburn had recently just gotten out of prison and has a 30 year history of alcohol-related charges.
He is charged with assault, DUI, and other charges.
He was moved from the hospital to the Floyd County Jail Sunday.
His bond is set at $500,000.
