Man allegedly tosses child from ATV

The incident took place after police received a report about a stolen four wheeler.

"Deputies developed information later in the day as to the whereabouts of that four wheeler." says Gilbert Acciardo, Public Affairs Deputy for the Laurel County Sheriff's Department.

Officials say the investigation led them to the residence of twenty five year old Larry Cunnigan on East Pittsburg Church Road in Laurel County.

"When our deputies pulled in the driveway they observed the suspected reported stolen four wheeler and the suspect standing beside the four wheeler." adds Acciardo.

According to police reports while attempting to flee, Cunnigan tossed his two year old off the four wheeler in a harmful manner.

But family members say that isn't the way things happened.

"They say he ran, but the four wheeler was off. So how do you run with the four wheeler off?" says Cunnigan's girlfriend, Misty Coffey.

Coffey, who was there when the incident occurred, says the child wasn't thrown in anyway.

"When they pulled up they pulled the tazer on him. Larry goes to hand me the child, I go to get him and that is when everything broke loose." she recalls.

Coffey also says she has proof of how things really happened.

"At all times on this premise, its been recorded. So there are cameras here and there is an attorney we are going to have working on this." she adds.

If Coffey does act upon this, she says the lawsuit would be filed against the Laurel County Sheriff's Department.

Fortunately, police say the child was not hurt in the incident. Larry Cunnigan was in court this morning for a bond hearing but no bond was set at the time.
