A man living at a Harlan County homeless shelter is charged with third-degree sodomy.

Police say fifty-two year old Brian Howard tried to have sex with a man while he was sleeping at Christ's Hands.

Howard was allegedly under the influence of alcohol at the time and police say he became combative after he was taken to the Harlan ARH.

Howard was later released on a $5,000 surety bond.
