Martin County man charged with murder and DUI

Police say a Martin County man involved in a deadly crash admitted to drinking before driving.

26 year old Billie Evans is charged with murder and DUI.

Police say Evans wrecked on Saturday. His passenger, 21 year old "Bubby" Irvin Spaulding, died.

"The wreckage looked like no one should have come out of the vehicle alive," said Martin County Coroner Joe Mullins.

Officials say on Saturday morning, Evans was driving on Route 292 in Warfield when he allegedly lost control, crossed the center line, and slammed into a tree.

"Looked like they had travelled at a high rate of speed," said Mullins.

The arrest citation says Evans failed field sobriety tests and admitted he had been drinking vodka earlier in the day.

"When I talked to him, he had slurred speech. He was not steady on his feet, and he seemed to be impaired," said Sheriff Garmon Preece.

State police charged Evans with DUI on Saturday after the crash. Officials say he refused medical treatment at the scene, and they took him to the Big Sandy Regional Detention Center.

On Monday, state police charged him with murder.

Tuesday morning, Evans waived his preliminary hearing, and the case went to the grand jury. His defense attorney did not want to comment.

Bond is set at $100,000.

Visitation for Spaulding is Tuesday and Wednesday at the Pack Bottom Church in Martin County. The funeral is Thursday at 1:00 at the Pack Bottom Church.
