Men indicted on federal hate crime charges

A grand jury indicted two Kentucky men on federal hate crime charges.

The U.S. Attorney for Kentucky released information about the charges against David Jason Jenkins and Anthony Ray Jenkins.

Police say the two lured Kevin Pennington from his home, kidnapped him and assaulted him because of his sexual orientation.

Police say the crimes happened in Harlan and Letcher counties.

A federal grand jury indicted the two men on a charge of violating a hate-crime law that was expanded in 2009 to cover assaults motivated by bias against gays, lesbians and transgender people.

Prosecutors say it's the first time in the nation the federal law has been used in a case alleging bias against a gay victim.
