MINGO COUNTY, W.Va. (WYMT/WSAZ) - A grand jury will now decide the case of two men charged for their roles in the murder of Mingo County woman.
Evelyn Farnum, 55, of Laurel Creek, went missing on December 30 but police found her body in her SUV in Laurel Lake on January 5.
The man who reported her missing was her boyfriend and third cousin, Donald Medley.
Donald Medley was charged with murder on January 4 after troopers say he confessed to killing Farnum.
"They had gotten into a fight, he became angered with her -- supposedly grabbed her, choked her to death and struck her in the face," said Trooper J.J. Dean of the West Virginia State Police.
Investigators say Medley then called his brother, Gregory, for help. They say the two men pushed the SUV into the lake. A witness later came forward to tip off troopers
Both men were in Mingo County Magistrate Court Tuesday for their preliminary hearings.
Prosecutors say Donald Medley waived his right to a hearing. A magistrate sent Gregory Medley's case to grand jury following testimony in the hearing. Only Donald is charged with the murder.
Prosecutor Michael Sparks tell us a grand jury is expected to hear the case in April.
