Mingo County, WV mother re-indicted on child neglect charges

A woman originally charged with child abuse resulting in death has been re-indicted by a Mingo County Grand Jury.

Brittany Scott, 25, formerly of North Matewan, W.Va., is charged with child neglect resulting in death.

Scott was originally charged with child abuse resulting in death, but that charge was dropped. Assistant Prosecutor Teresa Maynard says they believe the new charge, child neglect resulting in death, more accurately depicts the situation.

The charge stems back to an incident on March 18, 2011. Mingo County Sheriff's Cpl. Norman Mines tells our sister station that about 9 a.m. Scott left her 5-month-old child in his pack-and-play on the second floor.

According to Cpl. Mines, Scott told investigators she went to the first floor of her apartment in Magnolia Gardens, where she watched TV and napped with other children. It was 2:30 p.m. before she went to check on the baby again -- and she found him unresponsive in a garbage bag.

Scott was arraigned Thursday morning in Mingo County. Her bond was set at $70,000.

A trial date has been set for May 29.

If found guilty, Scott faces three to 15 years in jail.
