Murder suspect talks from jail

WHITESBURG, Ky. (WYMT) - James Maggard and Stephanie Fleming have been charged in the murder of Drad Fleming of Letcher County, and Monday, Maggard told side of the story.

“I’m not an evil person,” said Maggard.

He did not deny he was involved.

He said, “I done some of it I guess, I didn't do all of it.”

Maggard was dating Fleming's wife, Stephanie Fleming, and said on the night Fleming went missing he felt threatened on the top of Pine Mountain.

“He pulled a bat on me and I blacked out, and when I came to myself I was driving his truck, said Maggard.

However, there is one thing he said he did not do.

“I didn't set the truck on fire. I know for a fact I didn't do that,” said Maggard.

Police said witnesses claimed during preliminary hearings, that Fleming was still alive while Maggard drove his truck.

“I was going to park his truck where somebody would find him. I don't know if he was alive. I don't know if he was dead. I didn't check,” said Maggard.

The truck was found off Frank's Creek Road, at the bottom of an embankment.

“I got out to throw up and I don't know if I put the truck in park, or if I left it in gear; and it went over the hill and I ran,” said Maggard.

Maggard said he has only felt regret ever since.

“I ask myself a million times why, what could I have done different,” Maggard said.

A question that police and the Fleming family continue to ask.
