BELL COUNTY, Ky. (WYMT) - UPDATE 7-9-13
The Bell County man accused of firing shots at people on a porch pleaded not guilty to his charges.
State Police charged 38-year-old Albert Durham with seven counts of wanton endangerment and one count of possession of a handgun by a convicted felon.
Police say on July 4th, Durham fired first at the home in Arjay and then Tim Ogan shot him.
Police arrested Durham when he was released from the hospital.
The judge set his bond at $150,000. Jail records show he posted bond on Tuesday.
We have just been informed by the Kentucky State Police that Albert Durham was arrested Saturday.
Durham was shot Thursday during a dispute with neighbors.
He is charged with wanton endangerment.
Albert Durham was shot Thursday during a dispute on Garnett Loop Road.
He was the only person hurt, and was airlifted to UK Hospital.
Saturday, hospital officials say he has been discharged.
So far, no arrests have been made.
A night of fun and fireworks across the region for some turned into gunfire in one Bell County community.
State Police say a feud between neighbors led to the shooting Thursday night in the Arjay community.
Police say Albert Durham fired shots first, then Tim Ogan fired back, hitting Durham.
Ogan family members told us around 8:30 p.m. on July 4th, nine people were on a porch at a home on Garnett Loop Road.
None wanted to talk on camera, but they told us Albert Durham who lives across the street, rode by on an ATV and started shooting at them. Police say Tim Ogan, known as Head, fired back.
"That's a big surprise. I didn't figure that would ever happen to them," said Albert Gregory who does maintenance at the home where the shooting happened. He knows both men.
"I like Head and them and Albert both you know. They're good boys. They just, I guess, got into things they didn't need to," said Gregory.
"We're still looking into what led up to the shooting, but we do know that these two have had an ongoing dispute for quite sometime," said Trooper Shane Jacobs.
Police say no one on the porch was hurt. Durham went to Pineville Community Hospital and then was flown to UK Hospital in Lexington.
"There's charges pending in this case and we won't go into anything further than that," said Trooper Jacobs.
Police say they will release more information on the charges when an arrest is made.
Meanwhile Gregory says he is just glad the shooting was not worse.
"I hope both of them make it fine," Gregory said.
Kentucky State Police are continuing to look for the reasons for the neighborhood feud that led to the shooting.
We are tracking a developing story in Bell County.
Dispatchers say a man is in the hospital after being shot Thursday night at a home on Albert Durham Road off Route 66.
We do not know the man's name or his condition.
Dispatchers say he was taken by ambulance to Pineville Community Hospital.
At last check, Bell County sheriff's deputies were still on the scene.
