SOMERSET, Ky. (WYMT) - Police are investigating what caused a fatal car crash in Somerset, that involved two cars in, what police say, was a nearly head-on collision.

Bits and pieces are all that are left along West Highway 80, after the fatal crash on Saturday night.

Police say 33-year-old Levi Stephens of Somerset was driving in the westbound lane when he was hit head-on.

“It appears as though Mr. Stephens tried to avoid the collision as much as he could, but he just simply wasn't able to move out of the way far enough,” said Shannon Smith with the Somerset Police Department.

Stephens was hit by 36-year-old Justin Litton of Somerset.

Police say Litton was driving in the eastbound lane and crossed over the center line into oncoming traffic.

However, before the accident happened Litton caught police's attention by sitting in his car in the Jones Bros. parking lot with his headlights off.

“The deputy from the Sheriff's Office, obviously suspicious of theft or burglary or some type of criminal activity going on, turned around and was in the process of checking that car,” said Smith.

But within less than a mile of the deputy's following the car, Litton hit Stephen's Suzuki.

Stephens was pronounced dead shortly after the accident and Litton was flown to UK hospital for leg injuries.

Police found alcohol containers in the back of Litton's car, and say they are investigating if he was under the influence during the crash.

Litton is currently at UK Hospital listed in fair condition. Police say he was not wearing his seat belt.
