CABELL COUNTY, W.Va. (WYMT) - Straight out of the hospital the man who police say assassinated a West Virginia sheriff entered his plea Wednesday.

Tennis Maynard faces charges for the April murder of Mingo County Sheriff Eugene Crum.

Mountain News was in court as Maynard entered a not guilty plea.

Several of former sheriff Eugene Crum's family members were in the courtroom as Tennis Maynard entered a not guilty plea on all three charges he is facing.

Maynard entered the courtroom in his hospital gown and handcuffs just released from a lengthy hospital stay after he was injured in a shootout with mingo county deputies.

Wednesday was his first court appearance.

"First count charges you with the murder of sheriff Eugene Crum. Second count charges you with the attempted first degree murder of Deputy Norman Mines, and the third count charges you with fleeing with reckless indifference," Judge Paul Farrell read the counts.

Maynard spoke just a few words during his arraignment. His lawyer spoke for him to enter his plea.

"We enter a plea of not guilty on all counts," said Rich Weston, Defense Attorney.

Several Mingo Countians were in the courtroom. Many huddled around Rosie Crum supporting the late sheriff's family.

"Actually it was a smaller crowd than I might of expected, so yeah I'm sure emotions are involved as any first degree murder case," said Prosecutor C. Michael Sparks.

Maynard is currently being held in the Western Regional Jail without bond.

A bond hearing will be June 17.

A tentative trial date is set for October 21.

Prosecutors say because the venue has not been challenged the trial is set to take place in Mingo County.

HUNTINGTON, W.Va. (AP) - A West Virginia man accused of gunning down Mingo County Sheriff Eugene Crum may go on trial Oct. 21.

Tennis Melvin Maynard received the date after pleading not guilty at his Wednesday arraignment.

Maynard is accused of fatally shooting Crum on April 3. The sheriff was parked in downtown Williamson.

After a short vehicle chase, authorities say Maynard pulled a gun on a deputy who then shot and wounded him. He wore hospital garments at Wednesday's hearing.

A grand jury indicted Maynard on first-degree murder, attempted first-degree murder and fleeing charges.

Investigators have not discussed a possible motive. Maynard's father has said the 37-year-old has mental health issues.

The 59-yearold Crum had been a county magistrate for more than a decade when he successfully ran for sheriff last year.
