He was hiding from the cops with a warrant out for his arrest. Bell County Deputies had been trying to track down 35 year-old David Mason for some time.
They caught him this weekend, but now Mason is at UK Hospital with serious head and facial injuries. His family said they believe the sheriff's department went too far.
Mary Cox admits her son David doesn't have the cleanest slate.
"Went to prison, did his time for trafficking," said Cox, "he's been pretty rowdy."
That's why deputies were looking for him. He violated parole and a warrant was issued for his arrest.
"We're dealing with a guy here with a long criminal record that said he'd make threats against the officers when they came," said Bruce Bennett, Bell County Sheriff.
Mason left Sunday night on a four wheeler and headed into the woods. He wound up in a shack where authorities took him into custody.
"Couldn't recognize him. It was bloody. It was laid open from here to here," said Cox.
Mary Cox got a call Monday morning from Pineville Hospital saying her son was critically injured and was being flown to UK.
"He is hemorrhaging in the brain, in the back and in the front," said Cox.
"I asked him could he hear me. The only thing I could get out of him was a couple twitches," said Chris Cox, Mason's brother.
When family members went back to the woods they said they found a bloody board.
They also said the shack was full of blood.
"We heard a four wheeler running up there in that area, and he came out from behind the building and literally attacked Deputy Shane Stewart," said Bennett.
Sheriff Bruce Bennett said Mason came after the deputy and the deputy responded.
"The deputy was attacked. It's not like we found him and grabbed him," said Bennett.
"This is inhumane. This is uncalled for," said Cox.
The family provided us pictures, but they are too graphic for us to show. The deputies involved received minor injuries.
The family said they have talked with an attorney and are considering legal action. The sheriff's department has launched an internal investigation.
No action has been taken against the deputy involved.
Mason now faces additional charges of fleeing and evading police, assault, and resisting arrest.
He's listed in fair condition at UK Hospital in Lexington.
