An Eastern Kentucky coal company is under fire after state mine safety officials issue citations against them after the death of a miner.

The Lexington Herald Leader reports the citations stem from the death of Roy Sturgill on January 8th, who was working at the Blue Ridge Mine in Letcher County. Sturgill was backing up a rock truck to a dumping point when the truck went over the wall and he was thrown from the vehicle. He was later pronounced dead at Whitesburg ARH.

In the report, investigators say the barrier wasn't constructed well and was not built to keep a truck from rolling over it.

The real question is whether this citation will be enforced. There is no incentive for safety or regulatory compliance without a payoff or a penalty.
