A man charged with murder in connection with an accident that killed his 16-year-old cousin was back in court Thursday.

The accident happened about one year ago off highway 38 in the Coxton Community of Harlan County.

27-year-old Phillip Osborne is charged with murder and assault.

Police say Osborne was driving under the influence when he crashed in November of last year.

16-year-old Dustin Middleton, a passenger later died from injuries, but Middleton's family say Osborne should not be blamed.

Today a judge rejected a request to reduce Phillip Osborne's bond to a property bond.

i am truly sorry for your lose. this young man will have this on him the rest of his life.

This is a very sad story.One young life taken and another one's life getting ripped from him,because of a bad choice.Now how do we help these young men and women or can we?We need to pray for this family.God bless all!

this is a very sad story. it was an accident. the family has been through a lot i'm sure. if he had not been drinking it would have just been an accident. i pray for this family.
