Couple sues animal shelter over dog barking

James and Phyllis Walters live close to the Knox-Whitley Animal Shelter in rural Whitley County where hundreds of animals arrive each month.
And they claim in a lawsuit that the noises the dogs are making are simply too much to bear. They wouldn’t talk on camera, but they say in the lawsuit that the barking is persistent both day and night.
Deana Myers with the shelter says dogs are kept outside during the day..but at night it’s limited to only two areas.
“I don’t see how it could be that big of a problem. We do have an outside kennel. We house one outside animal. We do have an intake where we house up to 4 animals in the evening,” she says of the “quarantine area” where dogs are kept before they are ruled healthy enough to join the rest of the pet population.
The Walters claim in the lawsuit that the constant barking is causing them “severe insomnia,” injuries to their mental health, and loss of their property value.
Court records show that the Walters have lived in their current home since 1976. Whitley county officials say the animal shelter is less than 10 years old. The lawsuit claims problems began in January 2008. But shelter officials say if they can’t keep some animals outdoors..there’s really only one solution.
“We could do away with an outside kennel that we do have, that would mean another dog would have to be euthanized,” said Myers.
If they win the lawsuit, the Walters want an injunction that would stop the dogs from being housed outside and to be paid for compensatory and punitive damages.

Part of living in the country is animals, from barking dogs, horses, mules, donkeys, cattle, chickens, along with coyotes and various other animals of the wild. Anyone who knows the vicinity of the Knox-Whitley Animal Shelter is aware of the country setting it is located in. Sounds like a frivolous lawsuit to either benefit financially from the county government, or unrealistic and intolerant people that must have no clue about country living.

Animals play an instrumental role in the lives of many people. They are companions, protectors, and helpers for those disadvantaged. Just as humans need a homeless shelter when falling on hard times, animals need a shelter also to help get them back on their feet. This shelter provides an opportunity for the animals to find loving homes and not be wondering the neighborhoods getting into trouble. If there were no shelter, the neighborhoods (especially the one in which the people suing reside) would be plagued with animals getting into their garbage, destroying property, and BARKING on their doorsteps instead of yards away. Animals depend on humans to care and protect them. It is our duty as humane beings to ensure they are taking care of and that is what the shelter provides. People need to stop complaining about the situation and try to become a part of the solution. These people could work with the shelter to provide a means of helping the situation instead of burdening it down.

I think that it is awful that the people would even say anything. Animals have the right to be here the same as us. It makes me sad that anyone would say anything about it. They have no where to go.
