More charges possible in deadly DUI crash after court mix up

His cousin died in a crash police say he caused while on drugs. But a man only received four days in jail, because the judge and prosecutor both said they had no idea someone was killed.

Brian Pollard plead guilty to a DUI charge last week, stemming from a crash in Scott County in June that killed Peggy Williamson. But he could soon face new and more serious charges after a bizarre turn of events.

"I just don't understand how they couldn't know?" said Janet Brouillard.

Brouillard is Peggy Williamson's sister.

"We (our family) are trying to make sense of it. And it's only causing more heartache for us," she said.

During last week's sentencing, both the Scott County Attorney and District Judge Rebecca Phelps said they didn't know the passenger died in the crash.

Judge Phelps released this statement: "I am not permitted to comment on the case since prosecutors are saying that an additional charge may be fourth coming."

The Scott County Attorney and Commonwealth's Attorney both declined further comment at this time.

"She was just so special to us. She was awesome, just awesome," said Brouillard.

Now taking care of Williamson's 16-year-old son, Brouillard says, she is hoping all of this gets taken care of soon, so her family can move on, and focus on the good memories they made with Peggy.

"The court system is just so screwed up right now, and it needs to be fixed, we shouldn't be having to deal with this on top of losing my sister," she said.

According to her, the investigating agency, Kentucky State Police, told her they were going to charge Brian Pollard with involuntary manslaughter. When we asked KSP, they told us, right now they cannot comment on an open investigation, but said additional charges are possible.

Pollard is scheduled to serve his four-day jail sentence on Aug. 15.
But if more serious charges are filed, that sentence could be extended in the future.
