HARLAN, Ky. (WYMT) - Charges are dismissed in a Harlan County cold case.
Police charged Ernest Hensley with murder for the death of Harry Miller Maupin in 1985.
Maupin was a coal operator from Richmond. Police say Maupin and Hensley were business partners.
Maupin's body was never found but police say they learned he was shot and his body moved out of Harlan County. Police say new evidence in the case led to the arrest in 2010.
However, the judge dismissed the charges recently.
Former Commonwealth's Attorney Henry Johnson said there was not enough evidence to go to trial and some witnesses were not available to testify.
The case was dismissed without prejudice, meaning it can be presented to the grand jury again.
Johnson says the victim's family agreed to the court order dismissing the charges.
