UPDATE: Police say argument led to Harlan County shooting

State police rescued a woman and her five year old daughter during a shooting Monday night in Harlan County.

It happened at a home on Highway 522 in Totz.

Police say the homeowner shot his uncle in the leg during an argument.

Dispatchers at the Harlan KSP Post got an emergency call just before 11:30 on Monday night. A woman said she and her five year old daughter were locked in a bedroom closet while her fiance and a man argued in the living room.

"While they are talking to them, then they hear a gunshot," said Captain P.J. Burnett, Kentucky State Police.

Police say that was the homeowner, Jason Jones, shooting his uncle Johnny Irvin in the leg.

"Mr. Irvin was intoxicated and he had no reason to be at that residence," said Captain Burnett. "He entered the residence unlawfully."

Troopers arrived and got the woman and child out of the home through a bedroom window.

"She was very scared, obviously, that there was a man in their residence and she had a small child," said Captain Burnett.

Despite the gunshot wound, troopers say Irvin would not follow orders and troopers used their Tasers him. Irvin went to Harlan ARH and was transferred to Holston Valley Medical Center in Tennessee. Police say he is facing several charges including wanton endangerment, burglary, and DUI.

Police say they detained the homeowner for his safety following the shooting but he was not arrested and is not facing any charges at this time.

Police say Irvin threatened Jones first.

"He (Jones) gave him (Irvin) warnings to put down that object, which he didn't, and Mr. Irvin approached him, he fired one round striking him in the leg," said Captain Burnett.

Jones and his fiance were not at home on Tuesday, and a relative did not want to comment.

State police say a an argument led to a shooting in the Totz community of Harlan County on Monday night.

Troopers say Johnny Irvin was shot in the leg during an argument. Police say the homeowner Jason Jones was temporarily detained for his safety but not arrested.

Police say Irvin showed up at the home unannounced and intoxicated. Troopers say he unlawfully went into the home.

Police say at 11:20pm, Jones' fiance called 911stating Jones was in an argument with a man in the living room and she and her five year old daughter were hidden in a bedroom closet for safety. Dispatchers say the woman heard a gunshot while she was on the phone.

When troopers arrived, they got the woman and five year old girl out of the home through a window in the bedroom.

Troopers say Irvin did not comply with orders to walk outside of the home. Troopers went inside and deployed their Tasers on him.

Irvin went to Harlan ARH for treatment of the gunshot wound and was later transported to Holston Valley Medical Center in Tennessee.

Police have charged Irvin with wanton endangerment, menacing, resisting arrest, criminal trespassing, DUI, disorderly conduct, and burglary.

Kentucky State Police are investigating a shooting in the Totz community of Harlan County.

Police told WYMT it happened at a home just before 11:30 Monday night.

One man was injured.

No arrests have been made. Police are not releasing the names of anyone who was involved.
