Laurel mother learns punishment after plea deal on abandonment charge

LONDON, Ky. (WKYT) - It’s been 9 months since Rachel Kilburn’s 10 week old little girl was left at Johnny Reed’s home.. The infant died while there..but police say Kilburn was to blame. Her attorney disagrees.

“She left her children with 2 adults who are competent,” said Bryan Sergent.

Yet Tuesday Kilburn was still sentenced for the crime of abandonment of a minor. She entered an alford plea.

“Which basically means she does not believe she committed the crime,” said Sergent.

Yet police said the two adults caring for the 10 week old were not capable caregivers and they said Kilburn and her boyfriend left the baby for the sole purpose to go out and party.

“I don’t think it’s any different than yourself or someone going to a UK game and tailgating and leaving your children with a trusted relative,” said Sergent.

Her attorneys are not commenting on how the baby died or the findings of the autopsy report. But they do say that she had everything it would need while her mother was away.

“I believe that tragedies happen. We don’t understand them, don’t like them. Fact is they do,” said Sergent.

Kilburn’s 1 year prison sentence was diverted…and probated…meaning she will stay out of jail as long as she doesn’t get into trouble again.

“What I hope comes out of this that we all will make sure we pay more attention to giving people an opportunity to tell their side of the story,” Sergent said.

Kilburn’s boyfriend was also arrested but those charged were dropped Tuesday.
