LEXINGTON, Ky. (WKYT) - The Urban County Council has approved a zone change for a proposed shopping center near the intersection of Nicholasville Road and Man o' War Boulevard.
In a unanimous decision Tuesday night, the Council agreed to change the zone for the property that the shopping center would be built on from agricultural to mixed use community.
Bayer Properties wants to build the shopping center, called The Summit.
However, they faced opposition from some people who live in a nearby neighborhood, who worried about the traffic impact of another shopping center in the area.
"Council do not be a bully. Leave the neighborhood in tact," said Edward Prentice, who is opposed to the preliminary development plan and a zone change.
"I believe that the applicant has failed to discuss with you the most serious issue, and the issue that we believe requires that this development be scaled back," said Hank Graddy, who is the lawyer for those opposed, specifically the 'DON'T' group.
They just expressed that there was room for improvement, modification, and downsizing.
"This will be more intense than Fayette Mall. And that means it is too intense for this location on this road with the road operating in its current condition," said Graddy.
However, that's not how the developers and petitioners see it. They view it as an improvement from the mall area with an open concept presenting a mixed use community zone that would have retail and residential buildings both together and freestanding.
"The rule of the decision here is the section of the zoning ordinance, not some of the state standards that apply elsewhere. And we satisfy every single one of those," said Bill Lear, who represents the Fritz family selling their land and farm.
Once again, the zone change makes the new development possible. As for the retail businesses that will come to The Summit, they wouldn't say which ones and the ones they are talking with are subject to change.
Council members discussed a preliminary development plan for the shopping center on Tuesday night. But the city's planning committee will take up a final plan.
