A man convicted of murdering his wife plans to take his case to a judge Tuesday on why he thinks he should get a new trial.
A hearing on the appeal filed by Donald Southworth's attorneys is scheduled for Tuesday morning in Fayette Circuit Court.
Earlier this month, WKYT talked to one of his attorneys, who told us that during deliberations the jury requested to see a copy of some divorce papers.
However, they claim the document given to jurors didn't match what was presented at trial.
Attorneys also say Southworth was convicted of killing his wife, Umi, because of his character rather than proof beyond a reasonable doubt.
