Man charged with manslaughter after DUI crash

Richmond Police say charges have been upgraded against a man involved in a crash Friday night. They say 26-year-old Waydell Foster's car ran a red light at 10:30pm at the intersection of Lancaster Avenue and the Eastern Bypass.

Foster's car broadside a Jeep Liberty being driven by Jennifer Thurman. Police say a passenger in Foster’s vehicle, 33-year-old Nicholas L. King, suffered severe head and neck injuries and was transported to the UK Medical Center in critical condition. Officers do not believe that King was wearing a seat belt at the time of the accident. Foster and Thurman were not injured in the accident.

Upon making contact with Foster, police say officers observed that he appeared to be under the influence of an intoxicant other than alcohol and arrested him for D.U.I. Officers say evidence collected at the scene, including witness observations, indicated that Foster disregarded the red light at the intersection just prior to the collision.

In addition to being charged for D.U.I., Foster was charged for the following offenses at the time of the crash:

- Assault 1st Degree
- Wanton Endangerment 1st Degree
- Disregarding a Traffic Control Device
- Possession of Open Alcoholic Beverage Container in Vehicle
- Failure to Wear Seat Belts (For passenger)

Sunday morning, around 2:52am, Police say King died from the injuries suffered in the collision. Monday morning they charged Foster with Manslaughter 2nd Degree.
