A central Kentucky man in jail for a deadly crash has been denied a request for shock probation.
Police say Elmer French was drunk when he crashed his pickup into Jason Isaacs' car in Berea on December 3, 2008. French was originally charged with murder, but pleaded guilty to second degree manslaughter. In September, he was sentenced to seven-and-a-half years but last Thursday he asked a Madison County judge to let him out early.
His attorney argued French, who is in his seventies, and has health problems but prosecutors and Issac's family said shock probation would depreciate the seriousness of the crime.
The judge listed to both sides in court, and read letters written by French's family members before issuing his decision today to deny French's request.
