A former coal company CEO is asking to remain free on bond while he appeals his case.

Last week a federal judge sentenced Don Blankenship to one year in prison.

A jury convicted Blankenship of conspiring to violate mine safety laws while running Massey Energy's Upper Big Branch Mine.

An explosion there in 2010 killed 29 men.

Blankenship's attorneys argue he could end up serving his fu ll sentence before an appeals court reaches a decision.
