CYNTHIANA, Ky. (WKYT) - A man was shot and killed while breaking into his ex-wife's home on Kentucky 1842 in Harrison County on Sunday night.

The Harrison County coroner identified the man who died as Marcellus Custard, 57
Kentucky State Police Trooper Charles Loudermilk said Custard broke the glass out of the home's front door and was trying to unlock the door when someone inside the home fatally shot him.
WKYT's Victor Puente talked to Custard's ex-wife, Jacki Hess. Hess told WKYT that she and her boyfriend were in the home when Custard tried to break in. Hess said they told Custard to stop before her boyfriend fired a shot at him. Hess said when Custard did not stop, her boyfriend fired more shots and Custard died in her backyard.
According to Hess, she and Custard were married until the mid-2000's. They had an on-again, off-again relationship after their marriage ended but that relationship is over. Hess said Custard had been threatening her and her boyfriend, texting and calling them both repeatedly. Hess told WKYT she was the courthouse recently, dealing with an emergency protective order she had against him. She also said he recently spent a week in jail for an outburst in court.
Hess declined to do an on-camera interview. She said she felt bad for Custard's family, who she has known for years.
Hess said police took both her and her boyfriend's phone as evidence. So far, neither has been arrested or charged. State Police say they're are still investigating why Custard came to the home.
