Laurel County man found guilty in death of seven-week-old daughter

LAUREL COUNTY, Ky. (WKYT) - A Laurel County jury found Gary Nicely guilty in the death of his seven-week-old daughter.

After three days of testimony, the jury found Nicely guilty of second-degree manslaughter and third-degree criminal abuse. The jury found his wife Jessica Nicely innocent on all charges.

The couple’s baby died of a head wound in 2016.

At the time of the incident, hospital staff contacted police after the couple brought the baby into the hospital with severe head trauma. Gary Nicely originally told them he didn’t know how the child was injured. Police determined the incident happened while he was caring for the infant.

The baby’s twin sister was also taken to the hospital with injuries.

Jessica Nicely testified that she left the house for about an hour to an hour and a half and came back to the baby not breathing.

Officers originally charged the couple with assault in 2016, and those charges were upgraded to murder following the death of the child.
